Any person/entity claiming to be proprietor of the mark, including

Core Eligibility / Registration Criteria
- Applicant must claim proprietorship of the mark.
- Mark must be filed for the correct goods/services class(es) under Nice Classification.
- Application may be:
- "Proposed to be used", or
- based on prior use.
- If prior use is claimed, user affidavit and supporting use evidence are required.
- Mark should be capable of distinguishing the applicant's goods/services.
- It should not fall foul of statutory absolute/relative grounds, such as prohibited matter, generic/descriptive character without acquired distinctiveness, deceptive/confusing similarity, prohibited emblems/names, etc.
- A trademark search is strongly recommended before filing, but search itself does not guarantee registration.

Applicant
- Legal name.
- Address.
- Nationality/country of incorporation.
- Entity type.
- PAN/KYC for your internal onboarding, where applicable.
- Incorporation/registration proof for entity applicants.
Trademark
- Clear word mark / logo / device representation.
- If logo/device: high-quality representation.
- Brand spelling and description.
- Goods/services description.
- Class(es) requested.
- Date of first use in India, if prior use is claimed.
- "Proposed to be used" selection if not yet used.
Prior-use claim
- User affidavit.
- Supporting evidence, such as:
- invoices
- packaging/labels
- website/social media evidence
- advertisements
- purchase orders
- marketplace listings
- dated promotional material
Evidence should support the claimed first-use period and relevant goods/services.
Reduced-fee category - conditional
- Startup recognition certificate, if claiming startup fee category.
- Udyam/MSME/small-enterprise proof, where applicable to the fee category.
Agent/attorney filing - conditional
- Authorisation / Power of Attorney as required.
Priority/convention filing - conditional
- Foreign application details.
- Priority document/certified copy and translation where required.
Form / Fee Logic
- Main application: TM-A.
- Fee is charged per mark per class and depends on applicant category and filing mode.
- IP India currently publishes lower e-filing fee for Individual/Startup/Small Enterprise than for other applicants.
- Do not hard-code a service fee as "government fee"; store:
1) statutory government fee, 2) professional/service fee, separately.
